These Terms and Conditions (“Terms”) govern your use of topsellukcars.shop (the “Platform”), operated by TopSellUKCars, 1 Occam Court, Surrey Research Park, Guildford, Surrey, GU2 7HJ, United Kingdom (“we,” “us,” “our”). By accessing or using the Platform, you agree to these Terms.

1. What We Are

TopSellUKCars is a classified listings platform that allows users across the United Kingdom to advertise cars, trucks, buses and bikes for sale, and to browse listings posted by other users. We are not a party to any transaction between a buyer and a seller. We do not own, inspect, sell, or take title to any vehicle listed on the Platform unless expressly stated on that listing.

2. Eligibility

You must be at least 18 years old and a resident of, or acting from within, the United Kingdom to use this Platform. By registering, you confirm that the information you provide is accurate and that you have the legal right to sell or purchase the vehicles you list or enquire about.

3. Account Registration

You are responsible for maintaining the confidentiality of your account login details and for all activity under your account. Notify us immediately if you suspect unauthorised use of your account.

4. Listing Rules

When creating a listing, you agree that:

• All information provided (make, model, mileage, condition, price, photographs) is accurate and not misleading
• You have the legal right to sell the vehicle
• The vehicle is not stolen, subject to undisclosed finance, or otherwise encumbered
• You will not list prohibited, illegal, or unsafe vehicles
• You will respond to genuine buyer enquiries in good faith

We reserve the right to remove any listing that we reasonably believe breaches these Terms, without prior notice.

5. Fees

6. User Conduct

You must not:

• Post false, fraudulent, or misleading listings
• Use the Platform for spam, scraping, or unauthorised commercial activity unrelated to vehicle sales

7. Role of TopSellUKCars in Transactions

Any agreement to buy or sell a vehicle is made directly between the buyer and the seller. We do not guarantee the accuracy of any listing, the condition of any vehicle, or the conduct of any user. We strongly recommend buyers independently verify a vehicle’s history (for example, via an HPI check), arrange an inspection, and complete transactions safely, ideally in person.

Where a seller is acting in the course of a business, that seller — not TopSellUKCars — is responsible for complying with the Consumer Rights Act 2015 and related consumer protection law.

8. Intellectual Property

The Platform’s design, branding, and underlying software are owned by TopSellUKCars. Listing content (photos, descriptions) remains the property of the user who submitted it, but by posting it you grant us a licence to display it on the Platform for the purpose of operating our service.

9. Limitation of Liability

To the fullest extent permitted by law, TopSellUKCars is not liable for any loss or damage arising from:

• Transactions between users
• Inaccurate listing information provided by a user
• Any vehicle purchased or sold via the Platform
• Downtime, errors, or interruptions to the Platform

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

10. Termination

We may suspend or terminate your account at our discretion if you breach these Terms. You may close your account at any time by contacting us.

11. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
